Marital agreements - separation agreements and pre-nuptial agreements - have a long history in New York law and the courts have been extraordinarily reluctant to vacate them. But, new developments, some new challenges in our own Appellate Division and elsewhere, may give new life to such actions and the advent of the New York’s adoption of the Uniform Voidable Transactions Act a year ago may open the door further.
