Dollinger, New York State Supreme Court Justice Sara Stout Ashcraft, Esq., Ashcraft Franklin & Young, LLP Parental alienation is an emerging issue for matrimonial attorneys in contested custody cases and post-judgement litigation. Parental alienation is now asserted in requests to modify custody, visitation and support. In 2019 alone, 15 published New York opinions have mentioned this evolving theory of parental interference with custodial rights, and there are abundant questions regarding the role of parents, their counsel, Attorneys for the Children, expert witnesses, evidentiary issues, the impact of Lincoln hearings and other family related issues. This CLE will focus on those issues and provide insight into the complex legal and evidentiary issues that arise when parental alienation is asserted. Lunch and registration begin at 11:30 AM.
