The Small Business Reorganization Act of 2019 gives financially distressed small businesses and individuals a new lifeline in Bankruptcy Court. Under the new Subchapter V of Chapter 11, taking effect in February 2020, Congress has created a procedural mechanism for a new streamlined and simplified restructuring plan to be approved by bankruptcy courts to provide relief to the many small business owners who find themselves struggling to keep afloat. We will cover basic procedures for these new Small Business Subchapter V bankruptcies, try to anticipate how the court will administer these cases and try to identify those types of cases that would most benefit from this all-new opportunity for restructuring.
